SECOND BEST - Second Hand School Uniform Marketplace

Please read these terms of service carefully before using Our Service.

1. Introduction: These Terms and Conditions, along with the documents and policies referenced herein, form a legal agreement ("Agreement") between you ("User") and Meredith Joan Olsson trading as "Second Best," ABN 9530 4542 458 ("Facilitator"). The Facilitator operates the Second Best website ("Site") as an online platform facilitating the sale of second-hand school uniforms (“Uniforms”).

By accessing and using the Site as either a buyer or seller, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with these terms, you should refrain from using the Site.

2. Use of the Site: You acknowledge that your use of the Site is at your sole risk. You are personally responsible for all communications and activities undertaken on the Site. As a User, you agree to comply with the terms set forth in this Agreement.

3. No Ownership: The Facilitator does not own or hold title to any Uniforms sold through the Site, unless explicitly listed as the seller. Transactions between Users are purely contractual and occur solely between the buying and selling parties (“Buyer and Seller” respectively). The Facilitator is not a party to these transactions and bears no responsibility for the sale or purchase of Uniforms.
The school associated with the Uniforms has no control over, interest in, or hold any responsibility for transactions made using the Site. There are no financial, fee or commission arrangements or contracts between the school and the Facilitator regarding the Site or transactions effected through use of the Site.

4. No Warranty: The Facilitator provides the Site solely as a platform for Users to transact sales of Uniforms. The Facilitator makes no warranties regarding the suitability, quality, currency or acceptability of any Uniforms sold and is not responsible or liable for any claims made regarding suitability, quality, currency or acceptability of uniforms sold. The Facilitator does not inspect Uniforms or user-generated content and bears no responsibility for the accuracy of any photographs or descriptions provided by Sellers. The Facilitator does not warrant that photographs of uniforms posted on this site accurately reflect the true condition and colour of the Uniforms advertised for sale.
Buyers are encouraged to inspect Uniforms prior to purchase. The Facilitator does not verify the identities of Users, which may lead to instances where Users are not as represented.

5. Site Access: Users must register to create an account to buy or sell uniforms. Acceptance of these Terms is required upon registration.
Access to the Site is granted through a private login and password, which Users must keep confidential. Users are responsible for all transactions made under their login. Sharing login information is prohibited.
The Facilitator provides no warranties regarding site accessibility. Accessibility may be restricted from time to time due to factors outside the control of the Facilitator.

6. Sale and Purchase Transaction: All payments for second hand uniforms must be made using the third party online payment processor, Stripe, in accordance with the process described on this web site. Sellers will receive payment once the delivery has been made and the buyer confirms by clicking the green button "I've received my order" . Cash transactions are not permitted. You will be de-registered as a user of this site if you do not follow the Stripe payment process.

7. Seller Obligations: A User selling a Uniform agrees that they:

  • Hold legal title to and ownership of the Uniforms advertised.
  • Are responsible for the accuracy and legality of the content they post and must not post false, inaccurate misleading or defamatory content.
  • Will handle the delivery of the Uniform to the Buyer. In-person delivery should occur in a public place for safety and the Seller accepts all liability and responsibility for anything that may happen to the Buyer or Seller or anyone accompanying them when delivering in person.
  • Will use the Stripe payment process described on the Site for all transactions.
  • Will pay the Seller’s fee as specified on the Site.
  • Will advertise all prices in AUD and are responsible for any applicable taxes.

8. Buyer Obligations: A User buying a Uniform agrees that they:

  • Comply with the conditions specified on the Site.
  • Will use the Stripe payment process described on the Site for all transactions.
  • Will pay the Seller the advertised price in AUD.
  • Will pay the Buyer’s fee to the Facilitator as specified on the Site.

9. Meeting Arrangements: Buyers and Sellers are responsible for mutually agreeing upon the time and location for transactions. The Facilitator bears no responsibility for the logistics of these meetings or for any potential issues arising from them. In some cases, items may be advertised by a boarding family who may live in the country. In this situation the buyer and seller will need to come to an agreement with regard to the delivery of goods.

10. Respectful Conduct and Community Standards: Second Best is a community marketplace built on trust between families. All Users must conduct themselves in a respectful, honest and courteous manner when interacting with other Users and with the Facilitator. Users must not:

  • Engage in abusive, aggressive, threatening or harassing behaviour;
  • Post false, misleading, defamatory or retaliatory reviews or comments;
  • Make unreasonable demands or attempt to pressure other Users outside the agreed transaction terms;
  • Use offensive, discriminatory or inappropriate language;
  • Engage in conduct that undermines the integrity, safety or reputation of the Site. The Facilitator reserves the right, at its sole discretion, to remove reviews, restrict account functionality, suspend or permanently terminate a User’s access to the Site where behaviour is deemed to breach these community standards. The Facilitator is not obligated to mediate disputes and may determine, at its sole discretion, whether conduct breaches these Terms.

11. General Conditions of Site Use:

  • Users must be at least 18 years of age or have parental/guardian consent to use the Site.
  • The Site is intended for the sale of approved second-hand school uniforms only. Other items may be removed at the Facilitator's discretion.
  • The Facilitator reserves the right to restrict or ban Users from the Site without notice.
  • Users access the Site at their own risk. It is recommended that Users maintain current software protection.
  • The Facilitator is not liable for unauthorized access to User data.
  • The Facilitator does not guarantee the safety and accuracy of the content on the Site nor that the Site is free from errors or harmful components.

12. Delete Your Account: If you no longer wish to use the Second Best website, you can delete your account by following these steps: Click your initials in the top-right corner. Select Account Settings. Choose Manage Account, then select Delete Account.

13. Liability: The Facilitator is not liable for any losses incurred by Users using the Site. Where warranties are implied by law, the Facilitator's liability is limited to re-providing the services offered.

14. Indemnity: Users agree to indemnify the Facilitator against any claims or losses arising from unauthorized use of the Site or breaches of these Terms.

15. Governing Law: This Agreement is governed by the laws of South Australia. Any disputes will be resolved in South Australian courts.

16. Privacy: Contact details of either the buyer or seller will only be disclosed when a transaction has been actioned. User information will not be disclosed to third parties without consent.

17. Intellectual Property: The Facilitator holds all intellectual property rights to the Site's content. Users are prohibited from using, copying, or distributing this content without prior authorization.

18. Dispute Resolution: Second Best operates solely as a marketplace platform. Transactions are conducted directly between Buyers and Sellers, and the Facilitator is not a party to those transactions. If a dispute arises between Users, the Buyer and Seller must first attempt to resolve the matter directly between themselves in good faith. Where a dispute cannot be resolved, a User may submit a written request for assistance to the Facilitator via the Contact Us page outlining the issue. The Facilitator may, at its sole discretion:

  • Request further information from either party;
  • Review relevant messages or listing details;
  • Provide guidance based on these Terms; or
  • Decline to intervene.

The Facilitator is not obligated to investigate, mediate, or resolve disputes and makes no guarantee of any particular outcome. Once a Buyer confirms receipt of an item by selecting the “I’ve received my order” button, the transaction is deemed complete and payment will be released to the Seller. The Facilitator cannot reverse or cancel payments after confirmation, except where required by law. The Facilitator reserves the right to take action under these Terms, including review removal, account restriction, suspension or termination, where conduct is found to breach the Site’s standards.
